These Terms of Service ("Terms") govern your access to and use of the services provided by MyFairClaim LLC, including all automotive valuation products and related services. This includes, but is not limited to, diminished value reports, total loss assessments, market value opinions, appraisal clause support, and pre-purchase evaluations ("Valuation Services"). By accessing or using our services, you agree to be bound by these Terms.
1. Services Provided
MyFairClaim provides automotive valuation products for informational and support purposes. These include assessments and written reports estimating vehicle values in various contexts, such as post-accident diminished value, total loss situations, insurance disputes, or pre-sale/purchase evaluations. These services are intended to assist vehicle owners and other stakeholders in understanding potential vehicle value impacts. They are not guarantees of actual recoveries, sale prices, or legal/insurance outcomes.
2. No Legal Representation or Guarantee
We do not offer legal, insurance, or financial advice, nor do we represent clients in negotiations or proceedings. Our Valuation Services are based on industry data and professional judgment and do not guarantee acceptance by insurers, courts, arbitrators, or third parties.
3. Accuracy and Information Provided
You are solely responsible for the accuracy and completeness of the information you provide, including but not limited to accident history, repair records, vehicle condition, and supporting documentation. Unless otherwise stated in writing, MyFairClaim does not perform physical inspections and relies on user-supplied information, photographic evidence, and public records. All values and opinions are current as of the date the report is generated.
4. Limitations of Liability
To the fullest extent permitted by law:
- MyFairClaim shall not be liable for any indirect, incidental, consequential, or special damages arising from or related to your use of any Valuation Services.
- Our total liability for any claim arising from the use of our services shall not exceed the amount paid by you for the specific valuation product in question.
- We are not responsible for the outcome of insurance claims, legal proceedings, sales transactions, or third-party decisions based on our reports.
5. Intellectual Property
All content, formats, valuation methodologies, and templates used in our services are proprietary to MyFairClaim. You are granted a non-transferable, limited-use license to use the valuation product solely for personal, legal, or business purposes directly related to the subject vehicle. Redistribution or modification is prohibited without written consent.
6. Money-Back Guarantee
MyFairClaim offers a Money-Back Guarantee on diminished value reports purchased directly through this website. This guarantee is in addition to your statutory rights and is administered solely by MyFairClaim. The complete terms below govern every refund request; submission of a request constitutes acceptance of these terms.
6.1 Eligibility. A purchase is eligible for a refund under this guarantee only if all of the following conditions are met at the time the request is received:
- The refund request is submitted in writing to support@myfairclaim.com from the same email address used to place the order, no later than seven (7) calendar days from the date the report was delivered.
- The order was paid in full at the standard published list price. Orders purchased with a promotional, partner, or staff coupon code, or at any price below the standard published list price, are not eligible.
- The customer has not filed, submitted, presented, forwarded, or otherwise used the report — in whole or in part, in original or modified form — in any insurance claim, demand letter, dispute, negotiation, arbitration, complaint, or legal proceeding.
- The customer has not shared, transmitted, posted, published, or otherwise disclosed the report or any portion of it to any third party, including but not limited to insurers, attorneys, body shops, dealerships, social media, or online forums.
- The order is not a NO-PAMV order for which MyFairClaim has already extended an alternative delivery, partial credit, or replacement-report option.
- The customer has not previously received a refund from MyFairClaim under this guarantee for any prior order. Each customer is entitled to one (1) refund under this guarantee in their lifetime, regardless of the number of orders placed.
6.2 Required Submission. An eligible refund request must include, in a single email to support@myfairclaim.com, all of the following:
- The order number or Stripe receipt associated with the purchase.
- The email address used to place the order.
- The vehicle year, make, and model the report was generated for.
- A brief written statement confirming that the report has not been used in any insurance claim, demand letter, dispute, negotiation, arbitration, complaint, or legal proceeding, and has not been shared with any third party.
6.3 Processing. MyFairClaim will review eligible refund requests within five (5) business days of receipt. Approved refunds will be issued to the original payment method via Stripe. Upon issuance of a refund, the customer's access to all associated reports and tools will be revoked immediately.
6.4 Discretion. MyFairClaim reserves the right to deny any refund request that does not meet all eligibility conditions in Section 6.1, or where MyFairClaim has reasonable basis to believe the eligibility conditions have not been met, regardless of the customer's representations. This guarantee does not limit MyFairClaim's rights under Section 4 or any other provision of these Terms.
7. Dispute Resolution
Any disputes arising out of or related to these Terms or our Valuation Services shall be resolved through binding arbitration in the State of Delaware, under the rules of the American Arbitration Association. Each party is responsible for its own legal and administrative costs unless otherwise ordered.
8. Governing Law
These Terms shall be governed by and construed under the laws of the State of Delaware, without regard to conflict of law principles.
9. Modifications to Terms
We reserve the right to update or change these Terms at any time. Updates will be posted to our website and are effective immediately upon posting. Continued use of our services after changes constitutes acceptance of the new Terms.
