- We collect the information you give us (email, vehicle details, payment) and basic information your browser sends automatically (cookies, IP address, device type).
- We use it to deliver the diminished value reports you order, send you the emails you sign up for, run our business, and improve our website.
- We never sell your personal information.
- We share data with the vendors we use to run the service: Stripe (payments), Brevo (email), MarketCheck (vehicle data), Google (analytics and ads), and Microsoft Clarity (session replay).
- Analytics and advertising cookies are turned ON by default. You can turn them off at any time using the Cookie Settings link in the footer of every page, or by clicking the cookie preferences pill in the bottom-left corner.
- California, Virginia, Colorado, Connecticut, Utah, Texas, Oregon, and Montana residents have specific rights you can exercise by emailing support@myfairclaim.com.

1. Who We Are
MyFairClaim LLC (“MyFairClaim,” “we,” “us,” “our”) is a US-based diminished value appraisal service. We help vehicle owners document and recover the market value their cars lose after an accident.

This Privacy Policy covers myfairclaim.com and any other website, application, or service we operate that links to this policy (collectively, the “Services”).
2. Information We Collect
2.1 Information You Provide Directly
When you use our Services, you may give us:
- Contact information: name, email address, phone number
- Vehicle information: year, make, model, mileage, pre-accident market value, damage severity
- Account and order information: the tier you purchased, coupon codes used, billing address
- Communications: messages you send to support, chat transcripts with our support assistant, feedback you submit
- Payment information: processed directly by Stripe; we never see or store your full card number
2.2 Information Collected Automatically
When you visit our Services, we and our vendors automatically collect:
- Cookies and similar technologies: see Section 6 for the full list
- Device and browser information: browser type and version, operating system, screen size, language
- Usage information: pages viewed, links clicked, time spent on pages, referring URLs, scroll depth, search terms used on our site
- Network information: IP address (used for geolocation, fraud prevention, and rate limiting)
- Session replay: Microsoft Clarity records anonymized recordings of how visitors interact with our site (mouse movements, clicks, scrolls). Sensitive form fields like passwords and payment details are automatically masked.
2.3 Information From Third Parties
- MarketCheck: provides pre-accident market value verification for vehicles
- Stripe: confirms payment status and provides receipt URLs
- Brevo: confirms email delivery and engagement
- Google Ads and Google Analytics: advertising click identifiers (gclid), traffic sources, conversion events
- Microsoft Bing Ads: click identifiers (msclkid)
- Meta (Facebook): click identifiers (fbclid)
3. How We Use Your Information
We use the information we collect to:
- Generate and deliver the diminished value reports you purchase
- Process payments and send transactional emails (order confirmations, receipts, report delivery)
- Send marketing emails about your incomplete calculator submission, related services, and offers, only if you submit your email through our free calculator or opt in
- Provide customer support and respond to your questions
- Operate, test, and improve our Services and develop new features
- Measure the effectiveness of our marketing and advertising
- Detect and prevent fraud, abuse, and security incidents
- Comply with legal obligations and enforce our Terms of Service
4. How We Share Your Information
We share your information only as described below. We do not sell your personal information.
4.1 Service Providers
We share information with vendors who help us operate the Services. Each vendor is contractually required to use the data only to provide services to us. The main vendors are:

4.2 Legal and Safety
We may share information when we believe it is reasonably necessary to:
- Comply with a law, regulation, court order, subpoena, or other legal process
- Respond to a request from a government or law enforcement agency
- Protect the rights, property, or safety of MyFairClaim, our customers, or others
- Investigate or address fraud, security incidents, or violations of our Terms of Service
4.3 Business Transfers
If we are involved in a merger, acquisition, financing, reorganization, bankruptcy, or sale of company assets, your information may be transferred as part of that transaction. We will notify you of any such change in ownership or control of your personal information.
4.4 With Your Consent
We may share information with third parties when you direct us to or otherwise consent to the sharing.
5. We Do Not Sell Your Personal Information
We do not sell your personal information for money. We also do not “share” your personal information for cross-context behavioral advertising as those terms are defined under California law, except to the extent that our use of Google Ads and Microsoft Advertising conversion tracking may be considered “sharing” under California law. You can opt out of this at any time using the Cookie Settings link in our footer, by clicking the “Do Not Sell or Share My Personal Information” link on our site, or by enabling the Global Privacy Control signal in your browser, which we honor automatically.
6. Cookies and Tracking Technologies
We use cookies and similar technologies to operate, secure, measure, and improve our Services. Cookies fall into four categories.
By using our Services, you consent to our use of cookies as described in this section. For US visitors, analytics and advertising cookies are turned on by default. You can change your preferences at any time using the Cookie Settings link in our footer, by clicking the cookie preferences pill in the bottom-left corner of any page, or by emailing support@myfairclaim.com. Your preferences are stored for 13 months.

6.4 Personalization Cookies (default off, opt-in only)
We do not currently use personalization cookies. This category exists so that if we add them in the future, you can choose whether to allow them.

You can change your cookie preferences at any time by clicking Cookie Settings in the footer of any page on our site. You can also:
- Disable cookies in your browser settings
- Use the Global Privacy Control signal in your browser (we honor it automatically)

7. Email Communications
When you submit your email through our free calculator or order a report, we may send you transactional emails (order confirmations, receipts, report delivery, account notifications) and marketing emails (lead nurture series, related offers).
Every marketing email includes an unsubscribe link at the bottom. Clicking it removes you from our marketing list immediately. Transactional emails related to a specific order or account action cannot be opted out of while the order is active.
8. Your Rights
8.1 Rights Available to All Users
Regardless of where you live, you can:
- Access your personal information by emailing support@myfairclaim.com
- Correct inaccurate personal information by emailing support@myfairclaim.com
- Delete your personal information by emailing support@myfairclaim.com (subject to legal retention requirements; see Section 9)
- Opt out of marketing emails using the unsubscribe link in any marketing email
- Change cookie preferences at any time via Cookie Settings in our footer
8.2 Rights for California Residents
Under the California Consumer Privacy Act (CCPA) and the California Privacy Rights Act (CPRA), California residents have the following additional rights:
- Right to know what categories and specific pieces of personal information we have collected about you, the categories of sources, the business purpose for collecting it, and the categories of third parties we share it with
- Right to delete personal information we collected from you, subject to legal exceptions
- Right to correct inaccurate personal information
- Right to opt out of the sale or sharing of personal information (use the “Do Not Sell or Share My Personal Information” link or the Cookie Settings link in our footer)
- Right to limit use of sensitive personal information (we do not use sensitive personal information for any purpose that would require this opt-out)
- Right to non-discrimination for exercising any of these rights
To exercise these rights, email support@myfairclaim.com from the email address associated with your account, or call 1-877-503-3247. We will verify your identity before processing the request and respond within 45 days (extendable to 90 days for complex requests).
You may also designate an authorized agent to make a request on your behalf. The agent must provide signed proof of authorization, and we may still verify your identity directly.
8.3 Rights for Residents of Other US States
Residents of Virginia, Colorado, Connecticut, Utah, Texas, Oregon, Montana, and other states with comprehensive privacy laws have rights similar to those described in Section 8.2. Contact us at support@myfairclaim.com to exercise them.
8.4 Appeals
If we deny a privacy rights request, you may appeal the decision by replying to our denial response or emailing support@myfairclaim.com with the subject line “Privacy Rights Appeal.” We will respond to the appeal within 60 days.
9. Data Retention
We keep your personal information only as long as we need it for the purposes described in this policy. Specific retention periods are:
- Calculator submissions (email, vehicle inputs, results): retained indefinitely for analytics and to recognize repeat visitors. You can request deletion at any time.
- Order records and customer accounts: retained for at least 7 years to comply with tax, accounting, and consumer protection laws.
- Email marketing contacts in Brevo: retained until you unsubscribe or request deletion.
- Session replays in Microsoft Clarity: retained for up to 1 year.
- Google Analytics data: retained for 14 months per our property setting.
- Server access logs: retained for up to 90 days for security and abuse investigation.
- Backups: retained for up to 30 days. Deletion requests will be honored on production data immediately, with backups overwritten in the normal backup rotation.
10. Security
We use industry-standard administrative, technical, and physical safeguards to protect your personal information, including:
- Encryption in transit (HTTPS/TLS) for all data sent between your browser and our servers
- Encryption at rest for sensitive data stored on our servers
- Restricted access to production systems on a need-to-know basis
- Multi-factor authentication for administrative accounts
- Webhook signature verification for all payment and email integrations
- Regular security audits and dependency updates
No security measure is perfect. We cannot guarantee that unauthorized access or disclosure will never occur. If we discover a security incident that affects your personal information, we will notify you and applicable regulators as required by law.
11. Children’s Privacy
Our Services are not directed to children under 18. We do not knowingly collect personal information from children under 18. If you believe a child under 18 has submitted information to us, please contact support@myfairclaim.com and we will delete it.
12. Where Your Data Is Processed
We operate the Services from the United States, and most of your information is processed and stored on servers located in the United States.
Some service providers we use to deliver the Services process or store data outside the United States. Most notably, Brevo (our email and customer relationship platform) is a French company that stores contact and email engagement data exclusively on servers located in the European Union (Germany, France, and Belgium). The European Union has data protection laws that are generally stricter than those in the United States.
We do not currently serve customers outside the United States and do not target our Services to residents of the European Union, United Kingdom, or other jurisdictions outside the United States. If you access the Services from outside the United States, you understand that your information may be transferred to, stored, and processed in the United States or in any jurisdiction where our service providers operate.
13. Third-Party Links
Our Services may contain links to third-party websites (for example, Stripe’s hosted checkout pages or external articles we reference). This Privacy Policy does not apply to those websites. We encourage you to read the privacy policy of any third-party website you visit.
14. Changes to This Policy
We may update this Privacy Policy from time to time. When we do, we will update the “Last Updated” date at the top of this page. If we make material changes, we will notify you by email (if you have provided an email address) or by posting a prominent notice on our Services before the changes take effect.
We encourage you to review this Privacy Policy periodically.
