MyFairClaim LLC, a Delaware limited liability company ("MyFairClaim," "we," "us," or "our"), operates the website myfairclaim.com (the "Site") and provides automated diminished value appraisal reports and related claim tools (collectively, the "Services"). This Privacy Policy explains what information we collect, how we use it, who we share it with, and the choices and rights you have regarding your information.
By using the Site or Services, you agree to the practices described in this Privacy Policy. If you do not agree, please do not use the Site or Services.
1. Information We Collect
We collect the following categories of information:
1.1 Information You Provide Directly
When you purchase a report, request a free calculator estimate, contact us, or otherwise interact with the Services, you may provide:
- Identifiers: name, email address, phone number, mailing address (where applicable)
- Vehicle information: Vehicle Identification Number (VIN), year/make/model/trim, mileage, condition, prior damage history, location of incident
- Claim information: insurance carrier name, claim number, accident date, repair estimate amounts, photographs of damage (if uploaded)
- Payment information: payment is processed by Stripe; we do not store full credit or debit card numbers on our servers. We receive a transaction confirmation, the last four digits of the card, and the cardholder name.
- Communications: the contents of emails, support messages, and any other correspondence you send us.
1.2 Information Collected Automatically
When you visit the Site, we and our service providers automatically collect:
- Device and browser data: IP address, browser type and version, operating system, device type, screen size, language preference
- Usage data: pages viewed, time spent on pages, referring URL, exit pages, click paths, and similar engagement metrics
- Cookies and similar technologies: see Section 6 below
1.3 Information from Third Parties
To prepare your appraisal report, we query third-party data providers using information you provide (such as your VIN). These providers return:
- Vehicle specifications and history (from MarketCheck and the National Highway Traffic Safety Administration)
- Comparable market listings (from MarketCheck)
We do not receive credit, financial, or other sensitive personal information from these providers.
2. How We Use Your Information
We use the information described above to:
- Deliver the Services you purchase, including generating your diminished value appraisal report and providing access to claim tools
- Process payments and prevent fraudulent transactions
- Send transactional emails (order confirmations, report delivery, account notifications)
- Respond to support requests and communicate with you about your order
- Improve and maintain the Site, including diagnosing technical issues and analyzing usage patterns
- Comply with legal obligations and enforce our Terms of Service
- With your consent, send marketing or promotional emails (you may opt out at any time)
We do not sell your personal information, and we do not share your personal information with third parties for their own marketing purposes.
3. How We Share Your Information
We share your information only with the following categories of recipients, and only to the extent necessary to provide the Services:

Each service provider is contractually required to use your information only for the purposes for which we engage them and to maintain appropriate safeguards.
4. Data Retention
We retain your personal information for as long as necessary to provide the Services and to comply with our legal, accounting, and reporting obligations. In general:
- Order and report records: retained for at least seven (7) years for tax and audit purposes
- Email correspondence: retained for up to three (3) years from the date of last contact
- Analytics data: retained per the default retention settings of Google Analytics 4 (currently 14 months)
- Marketing email lists: retained until you unsubscribe, after which we retain a record of the unsubscribe request to honor it
You may request deletion of your information as described in Section 7.
5. Security
We use commercially reasonable technical and organizational safeguards to protect your information, including encrypted transport (HTTPS/TLS), access controls on our hosting and administrative systems, signed webhook verification for payment events, and regular security review of our codebase and dependencies. No method of transmission or storage is perfectly secure, however, and we cannot guarantee absolute security.
If we become aware of a security incident affecting your personal information, we will notify you and the appropriate authorities as required by applicable law.
6. Cookies and Tracking Technologies
We and our service providers use cookies, web beacons, and similar technologies to operate the Site, remember your preferences, and analyze how the Site is used. The categories of cookies we use are:
- Strictly necessary cookies: required for core Site functionality (e.g., session management, payment checkout, security). These cannot be disabled.
- Performance and analytics cookies: Google Analytics 4 cookies used to measure traffic and usage patterns in aggregate.
- Advertising cookies: Google Ads conversion and remarketing cookies, set when you arrive from a Google ad or interact with our advertising.
- Caching and performance cookies: set by our hosting and caching layer (LiteSpeed) to deliver pages faster.
When you first visit the Site, you will see a cookie consent banner that lets you accept all cookies, reject non-essential cookies, or customize your choices by category. Your selection is remembered for thirteen (13) months. You can change your selection at any time by clicking the Cookie Settings link in the footer.
We honor your choice using Google's Consent Mode framework, which means analytics and advertising tags are blocked from collecting data until you grant consent.
You can also opt out of Google Analytics by installing the Google Analytics Opt-out Browser Add-on and opt out of personalized Google Ads at Google Ads Settings.
7. Your Rights
7.1 California Residents (CCPA / CPRA)
If you are a California resident, you have the following rights under the California Consumer Privacy Act, as amended by the California Privacy Rights Act:
- Right to know: request disclosure of the categories and specific pieces of personal information we have collected about you, the sources of that information, the business purpose for collecting it, and the categories of third parties with whom we share it.
- Right to delete: request deletion of personal information we have collected from you, subject to legal exceptions.
- Right to correct: request correction of inaccurate personal information.
- Right to opt out of sale or sharing: we do not sell your personal information and do not share it for cross-context behavioral advertising. There is no sale or sharing for you to opt out of.
- Right to limit use of sensitive personal information: we do not use sensitive personal information for purposes that would trigger this right.
- Right to non-discrimination: we will not discriminate against you for exercising any of these rights.
To exercise any of these rights, email support@myfairclaim.com with the subject line "California Privacy Request" and describe your request. We will verify your identity before responding and will respond within forty-five (45) days as required by law.
7.2 All Other Users
Regardless of your location, you may:
- Request a copy of the personal information we hold about you
- Request that we correct or delete your information
- Unsubscribe from marketing emails using the unsubscribe link in any email we send
- Contact us with any privacy question or concern at support@myfairclaim.com
7.3 Authorized Agents
You may designate an authorized agent to make a request on your behalf. We will require written, signed authorization and verification of your identity before responding.
8. Children's Privacy
The Services are intended for adults aged 18 or older who own or are otherwise responsible for a vehicle. We do not knowingly collect personal information from children under 13, and we do not knowingly market to minors. If you believe we have collected information from a child under 13, please contact us at support@myfairclaim.com and we will delete it.
9. International Users
The Services are provided from and intended for users in the United States. If you access the Site from outside the United States, you understand that your information will be transferred to, stored, and processed in the United States, where data protection laws may differ from those of your country.
10. Third-Party Links
The Site may contain links to third-party websites (for example, state insurance department pages or insurer websites). We are not responsible for the privacy practices of those sites. We encourage you to read their privacy policies before providing any information.
11. Do Not Track
Some browsers offer a "Do Not Track" signal. Because there is no industry-standard interpretation of this signal, the Site does not currently respond to it. We instead provide the rights and choices described in Section 7.
12. Changes to This Policy
We may update this Privacy Policy from time to time. When we do, we will revise the "Last Updated" date at the top of this page. If the changes are material, we will notify you by email (if we have your address) or by a prominent notice on the Site before the changes take effect. Your continued use of the Services after the effective date of the revised Policy constitutes acceptance of the changes.
